MapGigs, Inc. ("MapGigs") has created this web site to provide an online resource for artists.

To assist you in using our website located at www.MapGigs.com ("Web Site" or "Site”), and to ensure a clear understanding of the relationship arising from your use of our Site, we have created a Privacy Policy and a set of Terms and Conditions of Use.

Our Privacy Policy explains how we protect and treat contact and other information you provide to us through the Site, and our Terms and Conditions of Use govern your use of our Site generally. Please read our Privacy Policy and our Terms and Conditions of Use carefully - they impose legal obligations on you. By using or accessing our Site, you are acknowledging that you have read and understood these terms and agree to be legally bound by them.

This Privacy Policy ("Privacy Policy") constitutes the agreement between you and MapGigs regarding your provision, and our collection and use, of contact and other information you may provide while using our Site. In this Privacy Policy, the words "you" and "your" refer to any person accessing the Site, and the words "we," "us," and "our" refer to MapGigs.
 
By using or accessing our Web Site, you are accepting the practices described in this Privacy Policy. This privacy statement covers the site www.MapGigs.com. This Privacy Policy applies solely to information collected by MapGigs.
 
By using our Web Site, you consent to our collection and use of information, in accordance with this Privacy Policy. If you do not agree with some, or all of this Privacy Policy, do not use or access (or continue to use or access) our Site. Types of Information you May Provide
Information we may collected from you while you visit or use our Site falls into two broad categories: personally identifiable information, and aggregate information. "Personally Identifiable Information" is information that can be used to identify or contact you, such as your name, phone number, email address, or mailing address. "Aggregate Information" is information that does not identify you, and may include, for example, statistical information concerning the web pages on our Site that users frequent. Our Privacy Policy governs both categories of information, as detailed below.
 
Personally Identifiable Information
We allow you to decide whether you wish to provide us with Personally Identifiable Information. Accordingly, we have structured our Web Site so that you may visit our Site, and review a range of information, without revealing your identity or providing any Personally Identifying Information.

One of our goals in creating this Web Site, however, is to enable artists to book gigs. In order to facilitate this and other Site features and to allow you to access certain other materials or information from our Site, we ask that you register and provide us with your contact and other information.
 
The information in a member’s profile is provided at their sole discretion. You input Personally Identifiable Information at your own risk. While we use commercially reasonable security measures to safeguard your Personally Identifiable Information, we cannot and do not guarantee the security of your Personally Identifiable Information. We are not responsible for circumvention of the security measures contained on the Site. Even after removal, copies of user content may remain viewable in cached and archived pages. When you update information, we may keep a backup copy of the prior version for a reasonable period of time.
 
We allow you at any time to update, correct, or delete Personally Identifiable Information you have provided us. After submitting your registration information, you can view and modify this information by accessing your "Profile" page.

If you request, we will remove your name and other Personally Identifiable Information from our databases. It may be impossible, however, to remove this information completely due to backups and records of deletions. Aggregate Information
When you browse our Site, the choices you make may provide us with Aggregate Information concerning your interests and the appeal and efficacy of associated Site features.

Aggregate Information does not identify a particular user, but does provide potentially useful data concerning our users' preferences. Because Aggregate Information does not personally identify our users, we do not provide our users with access to Aggregate Information, and users may not update, revise, or delete any Aggregate Information. The manner in which we collect Aggregate Information is explained below.

Cookies
We collect Aggregate Information about your use of our Site through cookies and similar Internet technologies. "Cookies" are small text files that a web site can use to recognize repeat users, to facilitate the user's ongoing access to and use of the site, and to compile aggregate data to improve the site and focus advertising. Cookies work as follows: a web site will send a cookie to your browser that uniquely associates your computer with information stored at the site. Your browser places the cookie in its cookies file. When you next access that site on your computer, the site recognizes your cookie, making the stored information available, and adding new information based on your current visit. Our cookies do not collect or retain your name or other Personally Identifying Information.

We use session ID cookies to confirm that users are logged in. These cookies terminate once the user closes the browser. By default, we use a persistent cookie that stores your login ID (but not your password) to makes it easier for you to login when you come back to the Site.
 
You can program your computer to warn you each time a cookie is being sent, block third party cookies or block all cookies. However, by blocking all cookies you may not have access to or the ability to use certain features on our Site.

IP Addresses
An "Internet Protocol" (IP) address is associated with your computer's connection to the Internet. We use your computer's IP address to maintain contact with you as you navigate through our Site. We also may use your computer's IP address to provide you with personalized content. Similar to cookies, your computer's IP address by itself does not identify you personally. We treat IP addresses, therefore, as Aggregate Information. If your IP address is combined by us with any Personally Identifiable Information, the combined information will be treated by us as Personally Identifiable Information.

Surveys and Questionnaires
If you choose to participate in surveys or questionnaires we may post on the Site, we may ask that, in addition to providing your responses, you also provide contact and other Personally Identifiable Information. If we link, or combine in any way your responses with your Personally Identifiable Information, we will treat the combined information as Personally Identifiable Information. If we separate your responses from or they exist independent of any Personally Identifiable Information, such that a third party reviewing your responses would be unable to link the responses to you or your computer, the responses will be treated as Aggregate Information.

Direct Communications
You may wish to provide us with comments and feedback concerning our Site. When communicating with us for these purposes, you may provide us with your email address and other Personally Identifiable Information. We will handle such information that you provide in this manner in accordance with our Privacy Policy for Personally Identifiable Information.
 
Referral Service
If we include a referral feature on the Site and you choose to use our referral service to tell a friend about our Site, we will ask you for information needed to send the referral invitation, such as your friend's email address. We will automatically send your friend a one-time email inviting them to visit our Site. We store your and your friend’s Personally Identifiable Information to send this one-time referral invitation, to register a ratified referral connection, and to track the success of our referral program. Your friend may contact us at Privacy@Mapgigs.com to request that we remove their information from our database.
 
Children Under Age 14
We do not knowingly collect or solicit information from anyone under the age of 14 or knowingly allow such persons to register. If you are under 14, please do not attempt to register on the Site or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 14 may provide any information to or on the Site. In the event that we learn that we have collected information from a child under age 14 without verification of parental consent, we will delete that information as quickly as possible. Children Between the Ages of 14 and 18
We recommend that minors over the age of 14 ask their parents for permission before sending any information about themselves to anyone over the Internet.

Non-US Residents
If you are accessing the Site from outside the United States, it is your responsibility to ensure that your use of our Web Site is in compliance with all applicable domestic and local laws, including whether our Privacy Policy complies with the requirements of your country’s privacy laws.

Use of Information
We use Personally Identifiable Information you provide to us on our Site for purposes specific to our Site.

When you register with the Site, you create your own profile. Profile information is presented back to and edited by you when you access the service.
 
We may use Personally Identifiable Information you give to us to provide you with information concerning newsletters, updates, and other materials related to the purposes of our Site and the services we offer. We will use this information to respond to questions and comments from you and to inform you of changes to our Privacy Policy or Terms and Conditions of Use. We may send you service-related announcements concerning the operation of our services. Generally, you may opt-out of newsletters, updates and service-related emails by contacting us Privacy@Mapgigs.com, though we reserves the right to send you notices about your account even if you opt-out of all voluntary email notifications.
 
MapGigs may use information in your profile, without providing information that could be used to identify you, to third parties. We do this for purposes such as aggregating how many people in a region tour a specific route, city or destination and personalizing advertisements and promotions so that we can provide you with benefits. For example, if you select a tour destination in your profile, we may serve you an advertisement highlighting a music store in that town. But we do not tell the music store who you are.
 
We may use information about you that we collect from other sources, including but not limited to newspapers and Internet sources such as blogs, instant messaging services, our platform developers and other users of the Site, to supplement your profile.
 
Sharing Information with Third Parties
We do not provide contact information to third party marketers without your permission. We share your information with third parties only in limited circumstances where we believe such sharing is 1) reasonably necessary to offer the service, 2) legally required or, 3) specifically authorized by you. For example:
  • We may provide information to service providers to help us bring you the services we offer. Specifically, we may use third parties to facilitate our business, such as to host the service at a co-location facility for servers, to send out email updates about the Site, to remove repetitive information from our user lists, to process payments for products or services, to offer an online application process, or to provide search results or links (including sponsored links).
  • We may be required to disclose user information pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. We do not reveal information until we have a good faith belief that an information request by law enforcement or private litigants meets applicable legal standards. Additionally, we may share account or other information when we believe it is necessary to comply with the law, to protect our interests or property, to prevent fraud or other illegal activity perpetrated through the Site or using the MapGigs name, or to prevent imminent bodily harm. This may include sharing information with other companies, lawyers, agents or government agencies.
  • If the ownership of MapGigs, Inc. or that portion of MapGigs’ that operates the Web Site were to change, your user information may be transferred to the new owner so the service can continue operations. In any such transfer of information, your user information would remain subject to the promises made in the then current Privacy Policy.

When you use the Site, any information you share with third parties (ex: a venue), such as personal information, Web Site URL address, photos, videos or other information, is done at your own risk and is not subject to this Privacy Policy.

 
Third Party Advertising
Advertisements that appear on the Site are sometimes served directly to users by third party advertisers. They automatically receive your IP address when this happens. These third party advertisers may also download cookies to your computer, or use other technologies such as JavaScript and "web beacons", enabling the third party to recognize your computer each time they send you an advertisement in order to measure the effectiveness of their ads and to personalize advertising content. In this way, third party advertisers may compile information about individuals using your computer or browsing their advertisements and determine which advertisements are clicked. We do not have access to or control of the cookies that may be in placed by third party advertisers. Third party advertisers have no access to Personal Identifiable Information we collect and store on the Site unless you choose to share it with them.
 
A pixel tag is a tiny image inserted in a webpage and used to record the number and types of views for that page. We may allow third party pixel tags to be present on the Site for purposes of advertising, providing services or data and statistics collection.
 
This Privacy Policy covers the use of cookies by our Site. It does not cover the use of cookies or other tracking technologies used by any other site.
 
Our Site may be linked to Internet sites operated by other companies. The Site may also carry advertisements from other companies. We are not responsible for the privacy practices of web sites or other services operated by third parties that are linked to or integrated with our Site or for the privacy practices of third party Internet advertising companies. Once you leave our Site via such a link, access a third party application (such as widgets), or click on an advertisement, you should check the applicable privacy policy of the third party or advertiser site to determine, among other things, how they handle Personally Identifiable Information. Security
We take commercially reasonable measures to protect our users' information. Your account information is located on a secured server behind a firewall. When you enter sensitive information (such as credit card number or your password), we encrypt that information using secure socket layer technology (SSL). Because email and instant messaging are not recognized as secure communications, we request that you not send private information to us by email or instant messaging services. Your use of our Site and any disputes arising from such use is subject to this Privacy Policy as well as our Terms and Conditions of Use and all of its dispute resolution provisions including arbitration, limitation on damages, indemnification and choice of venue and law. We reserve the right to change our Privacy Policy and our Terms and Conditions of Use at any time. Non-material changes and clarifications will take effect immediately. Material changes will take effect within 30 days of their posting on this Site. If we make changes, we will post them and will indicate at the top of this page the policy's new effective date.
